{"id":14363,"date":"2023-09-22T09:27:24","date_gmt":"2023-09-22T07:27:24","guid":{"rendered":"https:\/\/staging.csiasrl.eu\/senza-categoria\/new-state-regions-agreement-in-depth-analysis-of-the-draft\/"},"modified":"2023-09-22T09:27:24","modified_gmt":"2023-09-22T07:27:24","slug":"new-state-regions-agreement-in-depth-analysis-of-the-draft","status":"publish","type":"post","link":"https:\/\/staging.csiasrl.eu\/en\/news\/new-state-regions-agreement-in-depth-analysis-of-the-draft\/","title":{"rendered":"NEW STATE-REGIONS AGREEMENT: IN-DEPTH ANALYSIS OF THE DRAFT"},"content":{"rendered":"<p>[vc_row][vc_column][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">In recent days, the draft relating to the\u00a0<span style=\"color: #ff9900;\"><strong>new State-Regions Agreement<\/strong>\u00a0<strong>on training in the field of occupational safety<\/strong><\/span>, required by Law No. 215\/2021, known for having introduced the obligation for all Companies to \u201cidentify\u201d Supervisors, has been circulating online.<\/p>\n<p style=\"text-align: justify;\">The new Agreement aims to <span style=\"color: #ff9900;\"><strong>bring together and supersede the previous ones<\/strong><\/span>, in particular:<\/p>\n<ul style=\"text-align: justify;\">\n<li>the two <span style=\"color: #ff9900;\"><strong>Agreements of 21 December 2011<\/strong><\/span>, training for <span style=\"color: #ff9900;\"><strong>Workers<\/strong> <\/span>and <span style=\"color: #ff9900;\"><strong>Employers<\/strong><\/span> who take on the role of <span style=\"color: #ff9900;\"><strong>RSPP<\/strong><\/span>;<\/li>\n<li>the <span style=\"color: #ff9900;\"><strong>Agreement of 22 February 2012 <\/strong><\/span>on work <span style=\"color: #ff9900;\"><strong>equipment<\/strong><\/span>;<\/li>\n<li>the <span style=\"color: #ff9900;\"><strong>Agreement of 7 July 2016 <\/strong><\/span>relating to <span style=\"color: #ff9900;\"><strong>RSPP<\/strong> <\/span>and <span style=\"color: #ff9900;\"><strong>ASPP<\/strong><\/span>;<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">We therefore wish to analyse the scenarios contemplated in the draft of the new Agreement, identifying its key points.<\/p>\n<h4 style=\"text-align: center;\"><span style=\"color: #000000;\"><strong><em><u>Training providers<\/u><\/em><\/strong><\/span><\/h4>\n<p style=\"text-align: justify;\">The definition of training providers in the Agreement remains substantially unchanged compared with Chapter 2 of the 2016 Agreement.<\/p>\n<p style=\"text-align: justify;\">In addition to the provisions of the Agreement of 20 March 2008, training providers must have accumulated\u00a0<span style=\"color: #ff9900;\"><strong>at least three years of experience in occupational safety training<\/strong><\/span>. This requirement is not mandatory if only training for Workers, Supervisors and Managers is provided, while it becomes mandatory in all other cases.<\/p>\n<p style=\"text-align: justify;\">A <span style=\"color: #ff9900;\"><strong>training project for each course<\/strong><\/span> must be developed, with specific requirements defined in Part IV, point 2.6.<\/p>\n<p style=\"text-align: justify;\">A <strong><span style=\"color: #ff9900;\">maximum limit of 30 participants per course<\/span><\/strong> is established (previously it was 35). The <span style=\"color: #ff9900;\"><strong>instructor\/trainee ratio for practical activities is now 1\/5<\/strong><\/span>, unlike the 1\/6 provided for equipment in the previous agreement.<\/p>\n<p style=\"text-align: justify;\">The other substantive obligations remain similar to those of the 2012 and 2016 Agreements, but administrative details are provided for the management of documentation and the content of certificates.<\/p>\n<p style=\"text-align: justify;\">The draft of the new State-Regions Agreement clarifies that <span style=\"color: #ff9900;\"><strong>Employers<\/strong><\/span>\u00a0may take on the role of<strong>\u00a0<span style=\"color: #ff9900;\">training provider<\/span><\/strong>, but they must use <span style=\"color: #ff9900;\"><strong>qualified trainers<\/strong><\/span>, while Employers who meet the requirements for directly carrying out SPP tasks may directly train their own Workers, Supervisors and Managers.<\/p>\n<h4 style=\"text-align: center;\"><span style=\"color: #000000;\"><strong><em><u>Workers, Supervisors, Managers and Employers<\/u><\/em><\/strong><\/span><\/h4>\n<h4 style=\"text-align: justify;\"><span style=\"color: #000000;\"><em><strong><u>Course for Workers:<\/u><\/strong><\/em><\/span><\/h4>\n<p style=\"text-align: justify;\">The\u00a0<span style=\"color: #ff9900;\"><strong>contents of the course intended for Workers<\/strong><\/span>\u00a0are also extended to:<\/p>\n<ul style=\"text-align: justify;\">\n<li>members of family businesses pursuant to Article 230-bis of the Civil Code;<\/li>\n<li>self-employed workers who carry out activities pursuant to Article 2222 of the Civil Code;<\/li>\n<li>direct farmers operating in the agricultural sectors;<\/li>\n<li>partners in simple partnerships operating in agriculture;<\/li>\n<li>craftsmen and small traders, as provided for by Article 21 of Legislative Decree 81\/2008.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">However, <span style=\"color: #ff9900;\"><strong>participation in these courses is optional<\/strong><\/span>\u00a0and not mandatory.<\/p>\n<p style=\"text-align: justify;\">The\u00a0<span style=\"color: #ff9900;\"><strong>two-part structure<\/strong><\/span>\u00a0for these courses, <span style=\"color: #ff9900;\"><strong>general<\/strong> <\/span>and <span style=\"color: #ff9900;\"><strong>specific<\/strong> <\/span>is\u00a0<span style=\"color: #ff9900;\"><strong>confirmed<\/strong><\/span>, and the\u00a0<span style=\"color: #ff9900;\"><strong>content<\/strong>\u00a0<\/span>of the general module remains\u00a0<span style=\"color: #ff9900;\"><strong>unchanged<\/strong><\/span>. However, the draft abandons the differentiation by <span style=\"color: #ff9900;\"><strong>risk levels<\/strong><\/span>, stating that <span style=\"color: #ff9900;\"><strong>specific training must have a minimum duration of at least 6 hours and must refer to the risks identified by the risk assessment<\/strong><\/span>.<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong><em><u>Course for Supervisors: <\/u><\/em><\/strong><\/span><\/h4>\n<p style=\"text-align: justify;\">From a regulatory point of view, its minimum duration increases to <span style=\"color: #ff9900;\"><strong>12 hours<\/strong><\/span> \u2013 it was 8 \u2013 and its content is that of the previous Agreement, reorganised. However, the legislator leaves the Employer the possibility of further increasing the number of hours, according to the risks actually present in the Company.<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong><em><u>Course for Managers:<\/u><\/em><\/strong><\/span><\/h4>\n<p style=\"text-align: justify;\">the\u00a0<span style=\"color: #ff9900;\"><strong>course for Managers<\/strong><\/span>\u00a0is reduced to <span style=\"color: #ff9900;\"><strong>12 hours <\/strong><\/span>\u2013 it was 16 \u2013 and also becomes valid with reference to the obligations under Article 97 of Legislative Decree 81\/2008 (obligations of Employers of contracting companies, which require adequate training for the Managers of these companies on construction sites). Its contents are those provided for in the previous Agreement, reorganised. It is expanded with an \u201c<strong>additional construction-site module<\/strong>\u201d, with a minimum duration of <span style=\"color: #ff9900;\"><strong>6 hours<\/strong><\/span>, which addresses the topics of Title IV of Legislative Decree 81\/2008, <span style=\"color: #ff9900;\"><strong>but it is not clear whether attendance is mandatory<\/strong><\/span> in relation to the obligations provided for by Art. 97.<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong><em><u>Course for Employers:<\/u><\/em><\/strong><\/span><\/h4>\n<p style=\"text-align: justify;\">Finally, as expected, a\u00a0<span style=\"color: #ff9900;\"><strong>module for Employers<\/strong><\/span> is defined, with a minimum duration of <span style=\"color: #ff9900;\"><strong>16 hours<\/strong><\/span>, which may also be supplemented here by an \u201c<span style=\"color: #ff9900;\"><strong>additional construction-site module<\/strong><\/span>\u201d with a minimum duration of <span style=\"color: #ff9900;\"><strong>6 hours<\/strong><\/span>. The basic course is organised into two modules: Legal-regulatory and OSH organisation and management.<\/p>\n<h4 style=\"text-align: center;\"><span style=\"color: #000000;\"><strong><em><u>RSPP, ASPP and Coordinators:<\/u><\/em><\/strong><\/span><\/h4>\n<p style=\"text-align: justify;\">The training of the\u00a0<span style=\"color: #ff9900;\"><strong>Employer who acts as RSPP<\/strong><\/span>\u00a0is\u00a0<span style=\"color: #ff9900;\"><strong>r<\/strong><strong>enewed<\/strong><\/span>: in the past, training paths were divided into modules associated with three different risk levels: low 16 hours, medium 32 hours, high 48 hours, and the amount of training to be attended was identified\u00a0<span style=\"color: #ff9900;\"><strong>based on the ATECO 2002 sector of belonging<\/strong><\/span>, associated with one of the three risk levels.<\/p>\n<p style=\"text-align: justify;\">The new agreement provides for\u00a0<span style=\"color: #ff9900;\"><strong>a common module<\/strong><\/span>\u00a0lasting <span style=\"color: #ff9900;\"><strong>8 hours<\/strong><\/span>. To this must be added attendance of one of the supplementary modules relating to: Agriculture \u2013 forestry \u2013 animal husbandry, Fishing, Construction or Chemical \u2013 Petrochemical, which addresses specific topics in these areas.<\/p>\n<p style=\"text-align: justify;\">The\u00a0<span style=\"color: #ff9900;\"><strong>process for training an RSPP\/ASPP<\/strong><\/span>\u00a0remains unchanged, with attendance of modules A and B, and C only for the RSPP.<\/p>\n<h4 style=\"text-align: center;\"><span style=\"color: #000000;\"><strong><em><u>Content of training for coordinators during design and execution:<\/u><\/em><\/strong><\/span><\/h4>\n<p style=\"text-align: justify;\">The\u00a0<span style=\"color: #ff9900;\"><strong>draft of the new<\/strong><\/span>\u00a0State-Regions agreement also takes care to specify the\u00a0<span style=\"color: #ff9900;\"><strong>content of training for Coordinators during design and execution<\/strong><\/span>. The duration of the modules remains unchanged; there are some differences in the definition of the contents.<\/p>\n<h4 style=\"text-align: center;\"><span style=\"color: #000000;\"><strong>\u00a0<\/strong><strong><em><u>Confined spaces and work equipment:<\/u><\/em><\/strong><\/span><\/h4>\n<p style=\"text-align: justify;\">The <strong>\u00a0<span style=\"color: #ff9900;\">requirements for the course for Workers<\/span><\/strong>\u00a0operating in <span style=\"color: #ff9900;\"><strong>environments suspected of pollution or confined spaces<\/strong><\/span> are defined, starting from the minimum duration of <span style=\"color: #ff9900;\"><strong>12 hours<\/strong><\/span>. A legal-technical module is provided to illustrate hazards and their controls, and a practical module to enable the acquisition of the skills necessary for the use of equipment and PPE.<\/p>\n<p style=\"text-align: justify;\">The draft does not introduce substantial changes to the <span style=\"color: #ff9900;\"><strong>Agreement of 22 February 2012<\/strong><\/span>\u00a0relating to training in the use of particular categories of work <span style=\"color: #ff9900;\"><strong>equipment<\/strong><\/span>, except for the introduction of a one-hour legal-regulatory module, taken from the technical module so as not to change the total duration of the courses, and the inclusion of new equipment (overhead crane, etc.).<\/p>\n<h4 style=\"text-align: center;\"><span style=\"color: #000000;\"><strong><em><u>Training updates:<\/u><\/em><\/strong><\/span><\/h4>\n<p style=\"text-align: justify;\">The <strong>\u00a0<span style=\"color: #ff9900;\">obligations<\/span><\/strong>\u00a0of <span style=\"color: #ff9900;\"><strong>6 hours<\/strong><\/span> of <span style=\"color: #ff9900;\"><strong>five-yearly<\/strong> <\/span>update training for Workers, Managers and Employers, and <span style=\"color: #ff9900;\"><strong>6 hours every two years<\/strong><\/span> for Supervisors, are confirmed.\u00a0The\u00a0<span style=\"color: #ff9900;\"><strong>Employer who performs the duties of the prevention and protection service<\/strong><\/span>\u00a0must attend <span style=\"color: #ff9900;\"><strong>8 hours<\/strong><\/span> of update training every five years; ASPPs 20 hours, RSPPs and coordinators 40 hours, again every five years.\u00a0Workers operating in <span style=\"color: #ff9900;\"><strong>confined environments and environments suspected of pollution<\/strong><\/span> and Workers using work <span style=\"color: #ff9900;\"><strong>equipment<\/strong><\/span> must attend <span style=\"color: #ff9900;\"><strong>4 hours<\/strong><\/span> on a <span style=\"color: #ff9900;\"><strong>five-yearly<\/strong><\/span> basis.<\/p>\n<p style=\"text-align: justify;\">For a\u00a0<span style=\"color: #ff9900;\"><strong>transitional period of twelve months<\/strong><\/span>, it will be possible to deliver courses according to the previous Agreements; Employers must complete mandatory training within twelve months of the entry into force of the new agreement, and courses for Workers assigned to confined spaces that have already been delivered are recognised if compliant with the new Agreement.<\/p>\n<p style=\"text-align: center;\"><strong><em><u>In any case, we remind you that, to date, this\u00a0<\/u><\/em><\/strong><strong><em><u>Agreement<\/u><\/em><\/strong><strong><em><u> is<\/u><\/em><\/strong><em><u>\u00a0<\/u><\/em><strong><em><u>still in draft form.
