“I would like to point out that on 2 March last Decree-Law No. 19/2024 came into force: the measure contains – among other things – new provisions on labour matters for the prevention and combating of undeclared work, the strengthening of inspection activities and the combating of violations in the field of contributions and occupational safety.
An extremely relevant aspect is the introduction of the “points-based licence on construction sites”: from 1 October 2024, companies and self-employed workers operating on temporary or mobile construction sites are required to possess the licence.
The licence is issued, in digital format, by the competent territorial office of the Labour Inspectorate, subject to possession of certain requirements by the legal representative of the company or the self-employed worker applying for it.
The rule introduced establishes an initial score of 30 credits, with the possibility of continuing activities on site down to a minimum score of 15 points.
Credit deductions are provided for based on the outcomes of inspections and any measures issued for violations of occupational health and safety regulations. In any case, the licence is suspended as a precautionary measure in the event of fatal accidents.
The reinstatement of credits is provided for through participation in training courses.
The SOA certification obtained by the company excludes it from the application of the measure.
