SUPERVISOR UPDATE TRAINING: what to do in the absence of the New State-Regions Agreement on training
As already analysed several times, Decree-Law 146/2021 introduced important reforms regarding training and the role of the Supervisor. These changes should have been specified in the new State-Regions Agreement by last 30 June 2022, but its publication did not take place.
It is therefore necessary to clarify:
The obligation relating to failure to complete two-yearly update training will only be sanctionable from 21/12/2023. This is supported by INL Circular No. 1/2022, which provided inspectors with guidance regarding the non-sanctioning of failure to complete two-yearly update training before the new State-Regions Agreement.
Therefore:
- all those who completed the supervisor training/update course from 21/12/2021 will have a two-year expiry as provided by Conversion Law No. 215/2021.
- all those who completed the supervisor training/update course before 21/12/2021 must complete the course with a five-year expiry, provided that it is by 21/12/2023Â (i.e. within 2 years from the entry into force of the Conversion Law) and subsequently every two years.
The obligation relating to failure to complete two-yearly update training should only be sanctionable from 21/12/2023.
